1. Who We Are and What This Policy Covers
Onyx Ingenuity, LLC ("Onyx Ingenuity," "we," "us," or "our") is an enterprise software and technology company, a Florida limited liability company founded in 2020 and based in Miami, Florida. We develop commercial software products, provide implementation and advisory services, publish editorial content, and operate an online store with event registrations and community features. This Privacy Policy describes how we collect, use, and protect personal information when you visit our website (the "Site"), create an account, subscribe to our communications, make a purchase, register for an event, or contact us through the Site.
This Policy covers the Site only. Professional services engagements and product agreements are governed by their own written agreements, which control over this Policy for information handled within those engagements.
2. Information We Collect
Information you provide
Newsletter subscription: first name, last name, email address, subscription date, subscription source, and your marketing consent status. This information is collected and stored through Squarespace Email Campaigns, our website and email platform.
Account registration: if you create an account, your name, email address, and login credentials (held by our platform in protected form), together with the order history, event registrations, and service interactions accessible through your account.
Contact inquiries: your name, email address, and the contents of your message when you contact us through the Site or by email.
Purchases: when you buy from our store, your name, billing and shipping address, email address, phone number if provided, and details of the items you order. Payment card details are collected and processed by our payment processors, not by us; we never receive or store full card numbers.
Event registrations: when you register or RSVP for an event, your name, contact information, registration details, and any payment handled through our payment processors.
Marketing preferences: if you provide a phone number and select text message updates, we record that consent choice alongside your email marketing preference.
Information collected automatically
Usage and device information collected through our website platform (Squarespace) and analytics tools: IP address, browser type, device type, operating system, pages visited, time on page, referring pages, and general location derived from IP address.
Cookies and similar technologies, described in Section 5.
Embedded third-party content: some pages embed content from social platforms, such as Instagram media in our Digital Garage section. When you view a page containing embedded content, the platform providing it may collect usage data and set its own cookies under its own privacy policy.
Payments are processed by our third-party payment processors (Squarespace Payments, Square, and PayPal); we do not receive or store full payment card numbers. For customer service such as refunds, we may see limited transaction details provided by a processor, such as the last four digits of a card, but full card data is held by the processors, not on our systems.
3. How We Use Information
To process, fulfill, and ship orders, manage event registrations, and provide related customer service, receipts, and order or event updates.
To send you communications you have subscribed to, and to honor your marketing consent choices.
To respond to inquiries you send us.
To operate, secure, maintain, and improve the Site, including understanding how visitors use it.
To comply with legal obligations and enforce our Terms of Use.
We do not sell personal information, and we do not share personal information with third parties for their own marketing purposes without your opt-in consent. The only such sharing we offer today is event host sharing, described in Section 4, and it happens only if you choose it at registration.
4. How Information Is Shared
We share personal information only with service providers that operate the Site and our communications on our behalf, and only as needed for them to provide those services:
Squarespace (website hosting, forms, email campaigns, and cookie consent management).
Google (Google Analytics 4, Google Tag Manager, and Google Search Console) for site analytics and performance.
Payment processors (Squarespace Payments, Square, and PayPal) to process transactions you initiate. Their handling of your payment information is governed by their own privacy policies.
Shipping and fulfillment carriers, who receive your name and shipping address to deliver physical orders.
UserWay, which provides the accessibility widget available on the Site.
Event hosts, only with your consent: if you register for a hosted event and opt in at registration, we share your name and contact information with the host of that specific event, for that event’s coordination and the host’s own communications. You can decline the opt-in and still attend. You can withdraw consent for future host communications by emailing privacy@onyxingenuity.com or by opting out with the host directly.
We may also disclose information if required by law, legal process, or to protect the rights, safety, or property of Onyx Ingenuity, LLC or others, and in connection with a business transaction such as a merger, acquisition, or sale of assets, in which case this Policy will continue to apply to previously collected information unless you are notified otherwise.
5. Cookies, Analytics, and Your Choices
The Site uses cookies and similar technologies in the categories presented in our cookie consent banner: strictly necessary cookies required to operate the Site, and optional functional and analytics cookies used to understand aggregate site usage and improve performance. We use Squarespace’s native cookie consent tool, which lets you accept or decline optional cookies when you visit and change your choice at any time. We use Google Analytics 4 and Google Tag Manager for analytics.
We do not use advertising pixels, cross-site advertising trackers, or cross-context behavioral advertising, and we do not sell or share personal information for targeted advertising; as a result, opt-out preference signals such as Global Privacy Control have no sale or sharing to opt out of on this Site. Like most websites, the Site does not respond to browser Do Not Track signals. You can also manage cookies through your browser settings and Google’s available opt-out tools. Declining optional cookies does not prevent you from using the Site.
6. Email and Text Message Communications
If you subscribe to our communications, we will send you the content you signed up for. Every marketing email we send includes an unsubscribe link, and you can also opt out at any time by emailing privacy@onyxingenuity.com. Unsubscribe requests are processed promptly through our email platform. We honor your recorded marketing consent status and do not send marketing email to contacts who have declined it.
Text messages: we send marketing text messages only to individuals who have given prior express written consent by selecting text message updates and providing a phone number. Message frequency varies, message and data rates may apply, consent is not a condition of any purchase, and you can opt out at any time by replying STOP to any message or by emailing privacy@onyxingenuity.com. Transactional messages related to an order or event registration may be sent where permitted without marketing consent.
7. Data Retention
We retain personal information only as long as needed for the purposes described in this Policy: subscriber information for as long as you remain subscribed; account information for as long as your account is active; order records, including names and billing and shipping addresses, for as long as needed for fulfillment, returns, customer service, and tax and accounting requirements; inquiry correspondence for as long as reasonably needed to address and document the inquiry; and analytics data per the retention settings of our analytics tools. We may retain information longer where required by law or to protect our legal interests.
8. Security
We use commercially reasonable administrative and technical safeguards to protect personal information, including the security controls of our platform providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Children
The Site is a general-audience professional site and is not directed to children. Accounts may be created by adults 18 or older. A minor between 13 and 17 may hold an account only with the verifiable consent of a parent or legal guardian, and account activation for minors requires parental verification and approval. We never permit accounts for, or knowingly collect personal information from, children under 13, with or without parental approval. Any account found to belong to a person who misrepresented their age will be suspended immediately. If you believe a child has provided us personal information, contact us at privacy@onyxingenuity.com and we will delete it.
10. Your Rights and Choices
You may request access to, correction of, or deletion of the personal information we hold about you by emailing privacy@onyxingenuity.com. We will respond within a reasonable time and verify your identity before acting on a request. Depending on where you live, you may have additional rights under applicable state privacy laws; we will honor rights requests as required by the laws that apply to us and to you.
If you are located outside the United States and the law of your jurisdiction grants you additional privacy rights, you may contact us at privacy@onyxingenuity.com and we will honor your request as applicable law requires.
11. United States Operation
The Site is operated from the United States and is intended for visitors in the United States. If you access the Site from outside the United States, you understand that your information will be processed in the United States.
12. Third-Party Links
The Site may link to third-party sites we do not control. Their privacy practices are their own; review their policies before providing them information.
13. Changes to This Policy
We may update this Policy from time to time. Changes take effect when posted, and the "Last Updated" date will reflect the current version. Material changes will be noted on the Site.
